  1. Overview
    The general terms and conditions below will apply to sales by DECORSTONE SRL (hereinafter referred to as the "Seller"), through the virtual store/website www.decorstone.md to the Buyer, natural or legal person, as the case may be (referred to in hereinafter the "Buyer"), of the goods displayed on the Seller's website, as well as the provision of adjacent services provided by the Seller (e.g. Delivery Services). The goods that are the subject of trade through this website will be referred to as "goods" or "products".
    By concluding the distance sales contract (checking the box with "I have read the DECORSTONE Terms and Conditions" before placing the order or paying for it), by the Buyer with the Seller, the Buyer declares that he expressly accepts the terms and conditions below and obliges to comply with them.

    Using, accessing, using or browsing this site by visitors and users implies acceptance of the terms and conditions provided below.
  2. Description of goods/products
    All descriptions, specifications, advertisements, images (both printed and those on the Seller's website) and samples sent by courier or delivered to the Seller's showroom are presented for information purposes and are intended to give an approximate representation of the products . These cannot be considered the 100% benchmark because the products to be delivered are made of concrete, and variations in color, texture, marking, size between concrete batches or the like are normal for these products, the variations cannot be directly controlled by the Seller or its Suppliers.

    Considering the type of products (concrete) The buyer expressly declares that he has been informed and that he accepts the following:
    A. all descriptions, images (both printed and online) and samples sent by courier or delivered to the Seller's showroom can only provide an approximate representation of the products
    b. since the products are made by hand, there are variations between batches in terms of color, markings, texture, size
    c. some products can be scratched or chipped easily, so extra care must be taken when handling and transporting concrete products
  3. Prices: The displayed prices are based on the current costs of the products sold and include VAT.
    No product has the delivery cost included in the price. The delivery of the products to the address indicated by the Buyer will be made with the payment of the related costs.
    The seller reserves the right to change the prices displayed on the website, without being obliged to announce in advance the intention to change them. However, the Seller will not under any circumstances change the prices of an active order for which an advance payment has been received from the Buyer.
    If the price of some products ordered, but for which an advance payment has not been received from the Buyer, changes, the Seller will send a notification informing the Buyer, who will have the opportunity to withdraw by sending a notice to the Seller within 48 hours of receiving the notification regarding the price change.
    The price of the ordered product is the one displayed on the date of confirmation of the order by the Seller and is valid for 24 hours from the date of communication. In order to maintain the validity of the reservation, the Buyer undertakes to make the advance payment during the above-mentioned validity period. Otherwise, the reservation will be canceled and the goods will return to stock, available for sale. The price communicated at the order confirmation date will include all applicable taxes, as well as the price related to transport services, if transport is requested through the Seller. The shipping cost is mentioned separately on the order.
    a. Payment
    Orders are always paid in full before delivery / pickup from the showroom / warehouse.
    In the case of products that are not in the Seller's stock and are the subject of a special order (delivery term), the Buyer will pay an advance of 50% of their price at the time of placing the order, and the rest of the price will be paid by the Buyer to the Seller with at least two (2) days before the announced date for delivery.
    Payment by the Buyer to the Seller's bank account will be considered valid only after the corresponding amounts have been collected in the Seller's account.
    b. Availability of goods/products
    If the goods are in stock in the Seller's warehouse, then they will be released from the warehouse for delivery within 3 working days, excluding the day of placing the order. The delivery time of the goods depends on the delivery method selected by the Buyer.
    If the Seller's goods are not in stock for any reason, the Seller will notify the Buyer of this and will notify him of an anticipated date on which the products will be available for delivery.
    The Seller will not be held responsible and will not owe any damages or compensation to the Buyer in cases where the products are not available to be delivered at the time the order is placed by the Buyer.
  4. Technical steps for concluding the contract
    Using the menu related to categories and subcategories, the Buyer navigates until he finds the product that suits his wishes and needs. You can also search for products by using the search field

    a. Product selection
    To add the product to the shopping cart, press the "add to cart" button
    After adding a product to the cart, the Buyer will be redirected to the shopping cart, where he can update the quantity of the products added to the cart or remove products from the shopping cart. From the basket, he can complete the order or return to the store to continue shopping.
    The value of the delivery cost is automatically added to the value of the order. The cost for transporting the products differs depending on the method of delivery chosen by the Buyer, as well as the destination city.
    b. Sending the order
    The buyer can log in with his email address and password to use the delivery and invoicing information in his account.
    c. Billing
    In the next phase, the Buyer will have to complete the billing data. Thus, he has the option to order as a natural person, legal entity or association, by completing the fields related to the type of person.
    d. Choosing the delivery method
    When completing an order, the Buyer has the opportunity to choose the delivery method.
    The two delivery methods that the company DECORSTONE SRL makes available to its Buyers are:
    - delivery by courier for certain products selected by the Seller
    - pickup from the DECORSTONE showroom/warehouse in Chisinau, 30 Calea Iesilor Street.
    e. Choosing the payment method.
    Depending on the delivery method, DECORSTONE SRL offers you the following payment methods:
    - Refund for courier delivery
    -Online with VISA, MASTERCARD and paynet.md
    -Bank payment order
    - Bank card in the DECORSTONE showroom
    -Cash in the DECORSTONE showroom
    The Seller will issue, based on the information he has and the information provided by the Buyer, an invoice for the delivered goods.
    f. Order completion
    After the Buyer has chosen the method of delivery, payment and expressed his agreement by ticking the option "I agree with the clauses of the remote contract and the use of remote communication techniques", he will press the "Finalize" button and the order will begin of processing.
    After sending the order, the Buyer will receive a confirmation email from the Seller, regarding the receipt of the order. Later, the Seller will send an email confirming the processing of the order launched by the Customer.
    Once the online order is launched, the Buyer agrees with the subsequent form of communication (telephone or electronic) as well as with the Seller's mode of operation. Any order confirmed by the Seller involves the Seller and the Buyer in a distance contract.
    The moment of concluding the distance contract with the natural person, respectively, of concluding the sales contract with the legal person, is the moment of receiving the confirmation message from the Seller.
  5. Hours of operation. Delivery.
    Orders can be placed online 24 hours out of 24, 7 days out of 7, but their processing period takes place from Monday to Friday between 8am and 5pm. Orders placed on Saturdays, Sundays and legal holidays will be processed on the next working day.
    The operating hours are 8-18 Monday to Friday and Saturday from 8.00 to 13.00
    a. Delivery time
    The delivery time of the goods depends on the indicated delivery address, weather conditions, and other factors and will be communicated by the Seller to the Buyer. Delivery will normally take place Monday-Friday between 8.00-18.00, and Saturday between 8.00-13.00.
    Any dates that are fixed for the delivery of the goods are approximate and the Seller will not be responsible for any delay, regardless of what was the cause of this fact. The goods can be delivered by the Seller before the fixed delivery date, respecting the obligation of prior information of the Buyer
    If the Seller is unable, for any reason, to send the goods ordered by the Buyer (and in stock) within 14 days of placing the order, the Buyer has the right to cancel the order, and the Seller will refund any amounts paid by the Buyer for these goods. The Seller will not be responsible for any losses suffered by the Buyer for delayed deliveries or the impossibility of making the delivery for reasons related to the Buyer.
    If the Buyer or his representative is not at the address indicated for delivery, making it impossible for the delivery staff to deliver the goods, the return costs will be paid by the Buyer to the Seller within 5 days from the issuance of the related invoice.
    If the Buyer makes a return request for the delivery of the goods, he may be obliged to pay the Seller, before delivery, a new transport cost.
    The buyer is in default regarding the obligation to take over the goods within the terms specified below, these being calculated as follows:
    7-10 days maximum calendar days for stock goods, from the date of receipt of the order price and
    5 days calendars for orders of special parts, from the date of informing the customer about the arrival of the order in the DECORSTONE warehouse/showroom.
    If, for any reasons attributable to the Buyer, the delivery does not take place on the due date, the Buyer undertakes to pay the Seller 0.5 % of the total value of the order, per day of delay, as a contractual penalty.
    b. Schedule. Technical conditions
    All deliveries are made with the help of large tonnage vehicles, starting from 1 ton. The buyer is solely responsible for being able to bring the products onto his property for delivery.
    The seller undertakes to deliver against cost, as the case may be, the buyer undertakes to pick up the goods according to the conditions established at the time of placing the order. The transport quotations are established according to the destination, quantity, tonnage and specifications of the Buyer and will be communicated to him at the time of sending the invoice related to the order, according to the coordinates indicated by the Buyer at the time of placing the order.
    Deliveries are made, from Monday to Friday, between 8 a.m. and 6 p.m. The Buyer can specify a preferred delivery date, with terms longer than those indicated by the Seller, following which the Seller will adjust the delivery according to the Buyer's schedule, without additional costs. However, the goods are delivered or picked up within a maximum of 5 calendar days from the moment of information that the goods are available in stock to be picked up or delivered.
    The Buyer undertakes to inform the Seller at the time of indicating the place of delivery if there are any access restrictions or difficulties that a freight transport vehicle might encounter. The buyer is obliged to ensure the presence of an authorized person at the delivery address to sign the documents related to the delivery and reception and to supervise the unloading. The download is not performed by DECORSTONE employees. The goods are delivered at the Buyer's expense, but through the Seller's means, to the address indicated by the Buyer. The price related to the transport service is established and highlighted separately and includes VAT. If the characteristics of the indicated location do not allow the unloading and parking of goods transport vehicles, the Seller will not be held responsible and will not owe any damages or compensation to the Buyer for the non-delivery of the goods on time or the refusal of delivery.
    In these cases, the Buyer undertakes to provide the delivery staff with the nearest accessible unloading point, and otherwise, the Buyer undertakes to pay the Seller the round-trip transport value, as well as the costs related to a subsequent delivery, made with other means of transport that can fit in the respective location.
    The delivery staff is not obliged to handle the delivered goods.
    c. Making the reception
    The goods are received upon loading, in the case of picking up the order from the showroom and upon unloading, in the case of delivery to the address indicated by the Buyer.
    On the date of delivery, the technical condition of the delivered goods is checked, the parties having to sign, either through their authorized representatives or through their agents, the fiscal invoice and the goods delivery slip without objections, if the technical condition of the delivered products is considered satisfactory.
    If there are damaged/missing products, this will be recorded directly on the delivery note, and the Buyer will not accept the download for the damaged products without first notifying the Seller by phone and sending pictures by email. The seller undertakes to replace/replace the damaged/missing products within approx. 15 days from the date of discovery, in the case of products that are in stock or not subject to special orders. Any other subsequent complaint will not be accepted. Any defect, inconsistency, lack will be found upon loading/receiving the goods, and subsequent complaints will not be accepted. The Seller will not be held responsible and will not owe any damages or compensation to the Buyer in cases where the products are damaged as a result of any actions of the Buyer during the unloading operations following the delivery of the products.
    The customer can choose to pick up the order in person or through a representative, directly from the Seller's headquarters in Chisinau, str.Petricani 17/3, with prior notice and only with a vehicle that can be loaded with a forklift / loading-unloading equipment.
    "The loading of products in a personal car is limited to 300 kg to prevent damage to the vehicle. "
    The allowed percentage of goods that may have small chips / breaks or scratches is between 1 and 5 % maximum of the delivered quantity. In the case of products with LL (free length - variable - they can be from 5cm to 60cm long).
  6. Promotions are valid:
    a. for the limited time periods specified on the product presentation page in the virtual store
    b. within the limits of available stocks.
    DECORSTONE SRL cannot be held responsible for the damages caused by the information published in the virtual store by mistake or on partner websites.
    DECORSTONE SRL reserves the right to complete and/or modify any information in the virtual store without prior notice to the website users.
    DECORSTONE SRL reserves the right to contact the visitor of the virtual store by email or telephone if, after interacting with this site, he completes the identification and contact data and expressly requests any type of available information.
  7. Privacy
    The buyer will not make public, to third parties, by any means, any private information received from the seller, under penalty of obliging him to pay damages.
    The Seller reserves the right to use the information provided by the Buyer in order to perform the contract at a distance. Also, the Buyer will not disclose any information regarding the order to any third party without the written consent of the Seller.
    The Seller reserves the right, based on the prior consent of the user, to store and use in its own interest, for the purpose of carrying out marketing, information, invoicing or other similar activities, any information provided by the Buyer through the websitewww.decorstone.md.
    Also, he will not provide the information received from the Buyer to any third party, with the exception of agreed partners, service providers with whom there is a contract protecting this data received from the Buyer.
    When using the Seller's website, the user / Buyer will provide the Seller with personal information that will only be used to complete the order, prepare the delivery, in case of any confusion that may arise and inform the Buyer about any special or new offers product range.
  8. Transfer of property
    The transfer of ownership of the products will operate on the date of collection of their price by the Seller, and the transfer of related risks will operate on the date of effective delivery to the Buyer.
  9. Exercising the right of withdrawal. Acceptance of goods and return policy
    The buyer will refuse the delivered goods if they do not comply with the technical details specified in the order. In this case, the Seller assumes the responsibility of bringing the products into compliance.
    The natural person buyer has the right to notify the Seller in writing that he/she is canceling the purchase, without penalties and without citing a reason, within 14 calendar days from receiving the product, contractual provisions applicable only to natural person buyers and can return the product(s) in the same term of 14 days. Canceling the purchase within 14 calendar days can only be applied to products ordered and purchased online either delivered by the Seller or picked up by the Buyer from the showroom.
    The date of receipt of the products is the date of their collection from the representative of the courier/carrier company. This date can be verified and demonstrated by the delivery documents handed out by the courier/carrier.
    The returned product must be in the same condition in which it was delivered (in the original packaging with all the accessories and documents that accompanied it).
    The buyer will have to bear the additional costs related to the return of the products in case of withdrawal. The additional costs represent any costs (transportation, delivery, reduction of the value of the products resulting from manipulations, other than those necessary to determine the nature of the qualities and functioning of the products, postal taxes or of any other nature) to be borne by the consumer when exercising the right withdrawal.
    The return of the products is made within 14 calendar days from the date of delivery of the products, based on the return form that you can access here and to be considered, the return form can be sent no later than the 14th day calendar from the product delivery date.
    The reimbursement of the amounts is made within 14 calendar days from the physical receipt of the products in the DECORSTONE warehouse, in the bank account indicated by the Buyer in the Return Form.
    Depending on the method of delivery of the products selected by the Buyer, the amount reimbursed will be equal to the amount resulting from the retention by the Seller, from the price paid by the Buyer, of the amounts related to transport and delivery expenses. The refund of the collected amounts, if the Buyer does not want another product, will be made by bank transfer, to the account indicated in writing on the Return Form by the Buyer.
    Products that:
    - exceed the term of 14 calendar days from the date of receipt;
    - are part of the "Exclusive items made to order" range
    - correspond to the technical specifications mentioned in the order;
    - they were the subject of a special order;
    - they were subject to a final stock liquidation, after which the Buyer benefited from a price reduction;
    - they were purchased from the showroom and, although they had some defects, the Buyer accepted them and benefited from a corresponding price reduction;
    - were distinctly personalized at the Buyer's request;
    - were executed according to the Buyer's specifications;
    - shows signs of impact or damage;
    - shows visible signs of wear;
    The products must be returned in the original packaging (the packaging in which they were purchased), with all the accessories and the original label, intact (no traces of use, damage, impact), the products are undamaged, unused, do not show traces of glue or other similar substances. These are returned in the packaging unit (package, box, bag, crate, etc.), and will be accompanied by all the accessories with which they were delivered, as well as the fiscal invoice and/or purchase receipt.
    Failure to comply with the above conditions, as well as putting the product, by any means, in a condition unsuitable for resale, leads to the refusal of the return.
    For products picked up by the Buyer directly from the store/showroom, for which the Buyer had the opportunity to directly verify the quality and specifications presented, the return conditions provided in this section do not apply.
    Both in the case of remote orders and in the case of those made in the Seller's showroom, the return of the goods will be made in full for a certain position.
    Partial returns from a certain position in the invoice are not accepted.
    The full return of the paid consideration will be made only if the products are in proper condition. Damage to the product caused by the Buyer or improper use of the product will be borne by the Buyer, and the respective products will not be subject to return. If the product has been used by the Buyer and can no longer be returned in proper condition, DECORSTONE will not be able to return its value.
  10. Major force
    None of the Parties will be liable to the other Party for non-execution of the obligations resulting from this Agreement, in the event that this non-execution was caused by force majeure.
    In the event of the intervention of a case of force majeure, the Party interested in invoking it is obliged to take all measures reasonably necessary to remove the consequences of force majeure and to notify the occurrence of the case of force majeure to the other Party within 5 days. Violation of these obligations removes the effects of force majeure on the Contract, the guilty Party remaining obliged to answer for the non-fulfillment of its obligations.
    If the effects of force majeure last more than 90 days, any of the Parties has the possibility of unilaterally terminating the Contract, without any penalty for any of the Parties.
  11. Litigation. applicable law
    Any disputes that arise between the Buyer and DECORSTONE SRL will be resolved amicably. If this is not possible, the resolution will go to the competent courts in Chisinau.
  12. Copyright. Limitation of Liability
    All content on www.decorstone.md (which includes, but is not limited to): texts, graphics, visuals, products, ideas, pictures, videos, sounds are the property of DECORSTONE SRL, with the following identification data: c/f: 1013600007006, str.Petricani 17/3, Chisinau municipality, Republic of Moldova. RockStar does not guarantee that the website www.decorstone.md and its content does not contain errors or that the entire content is 100% correct and valid. It is not permitted under any circumstances to take over the content from www.decorstone.md for commercial purposes. In case of certain complaints / problems / suggestions related to copyright, please write us an email at decorstonemd@gmail.com and you will receive an answer within a maximum of 48 hours after receiving the email.
    Any omission, typographical or drafting error that appears in the sales literature, offers, price list, invoice or other document or information issued by the company will be corrected without any liability on the part of the Seller.
    Graphic signs, names, brands (such as, for example: the name of the DECORSTONE website and company) are the property of DECORSTONE and may not be taken over and/or used without the prior written consent of the owner.
    The user will not copy, distribute, retrieve, publish for commercial purposes any information contained in the DECORSTONE virtual store, without the prior written consent of the site owner.
    Any unauthorized modification of the site is prohibited.
    DECORSTONE is the holder of all intellectual property or copyright rights over the virtual store, respectively over the brands, design, site functionalities, images and technical specifications.
    The characteristics of the products and their related technical documentation, presented on the website, are made available by the manufacturers and suppliers, and DECORSTONE offers the technical support for their display.
    DECORSTONE is not responsible for damages caused, for reasons that exclude its fault, by the non-functioning of the virtual store as well as for those resulting from the impossibility of accessing the pages of the virtual store (e.g. defects in the Internet network).
